Terms of Service

1. Acceptance

By signing in to CybrOak (“Service”), operated by ExanixSolutions LLC, you (“Customer”) agree to these Terms. If you sign in on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

CybrOak Ops provides a software-as-a-service platform that reads endpoint metadata from your Microsoft Intune tenant via the Microsoft Graph API, computes risk scores, surfaces findings, and may push remediation policies back to Intune when you explicitly request it. We do not install software on your endpoints.

3. Your responsibilities

• Keep your Microsoft administrator credentials secure
• Grant CybrOak only the permissions necessary for the features you use
• Review remediation actions before applying them in production
• Don't attempt to access other customers' data, reverse-engineer the service, or use it to harm endpoints you don't own

4. Free tier and paid plans

We offer a free tier with usage limits. Paid plans bill monthly or annually in advance and are non-refundable except where required by law. You can cancel at any time; access continues through the end of the billing period.

5. Service availability

We target 99.5% uptime for the production service. We may schedule maintenance with reasonable advance notice. We are not liable for downstream effects of Microsoft Graph API outages or rate-limiting.

6. Data ownership

You own all data you provide or that CybrOak reads on your behalf. You grant us a limited license to process that data solely to provide the Service. We don't sell, share, or use your data to train AI models.

7. Confidentiality

Each party will protect the other's confidential information with the same care it uses for its own, and at minimum reasonable care. Our security practices are described in our Privacy Policy.

8. Termination

Either party may terminate for any reason with 30 days' written notice. We may suspend or terminate immediately for breach, non-payment, or if continued service would harm other customers or violate law. On termination, you may export your data for 30 days, after which we permanently delete it.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CybrOak is a decision-support tool, not a replacement for your IT and security judgment.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES. EACH PARTY'S TOTAL LIABILITY IS LIMITED TO THE FEES PAID TO CYBROAK IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware.

12. Changes

We may update these Terms. Material changes will be announced by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
